These Terms & Conditions ("Terms") govern your access to and use of Smart DigitalWay, including our website, digital business card platform, visiting card generator, and any related services (together, the "Service"), operated by Smart DigitalWay ("we", "us", "our"). By creating an account or otherwise using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By registering for an account, verifying your mobile number, or using any part of the Service, you confirm that you are at least 18 years old (or have the consent of a parent/guardian), and that you have the authority to enter into this agreement on behalf of yourself or the business you represent.

2. Description of Service

Smart DigitalWay lets you create a shareable digital business card with your contact details, services, products, gallery, testimonials, and a QR code that links to your live card. We also offer a printable visiting card generator, a WhatsApp-based quick-contact and enquiry system, and referral and partner programs. We may add, modify, or remove features at any time.

3. Account Registration & OTP Verification

Registration requires a valid mobile number, which is verified via a one-time password (OTP) sent over WhatsApp. You are responsible for:

• Providing accurate, current information during registration and keeping your card details up to date.
• Keeping your account and mobile number secure — anyone with OTP access to your registered number can log in to your account.
• All activity that occurs under your account.

We reserve the right to suspend accounts that provide false information or that we reasonably believe are being used fraudulently.

4. Plans, Free Trial & Billing

Card creation requires an active plan, including our free trial where offered. Please review the following carefully:

• Free Trial: New users may be offered a free trial (currently 7 days) with limited features. It must be actively selected from the Plans page before you can create a card.
• Paid Plans: Paid plans are billed for a fixed duration (as shown at checkout) and unlock additional features such as premium themes, custom CSS, and a higher number of cards, depending on the plan.
• Expiry: When your trial or plan expires without renewal, your published card is automatically taken offline (unpublished) until you renew. Renewing restores a previously-approved card to publish status automatically.
• Renewal: Plans do not auto-renew unless explicitly stated at checkout; you will need to manually renew or upgrade from the Plans page.
• Taxes: All prices are inclusive or exclusive of applicable taxes as indicated at checkout.

5. Your Card Content

You are solely responsible for the content you upload to your card — including your photo, company logo, services, products, testimonials, and any documents. You agree not to upload content that:

• Is unlawful, defamatory, obscene, or infringes on someone else's intellectual property or privacy;
• Impersonates another person or business you are not authorized to represent;
• Is used for spam, phishing, or any other fraudulent or deceptive purpose.

We reserve the right to review, reject, or unpublish a card that violates these Terms, with or without prior notice, particularly during our admin approval process for newly published cards.

6. Referral & Partner Program

Users may earn wallet credit by referring new users who go on to purchase a paid plan, subject to the terms shown on the Referral Program page. Approved Partners may additionally register independent client accounts on their behalf and earn the same referral credit once that client subscribes. Referral rewards are credited at our discretion and may be withheld in cases of suspected abuse, self-referral, or fraudulent signups. Partner status is granted at our sole discretion following application review and may be revoked for violation of these Terms.

7. Intellectual Property

The Smart DigitalWay name, logo, platform design, and underlying software are our property or that of our licensors. You retain ownership of the content you upload, but grant us a limited license to host, display, and transmit that content as necessary to operate the Service (for example, showing your card to visitors who scan your QR code).

8. Suspension & Termination

We may suspend or terminate your account or unpublish your card, without prior notice, if we reasonably believe you have violated these Terms, engaged in fraudulent activity, or if required by law. You may stop using the Service and request account deletion at any time by contacting support.

9. Limitation of Liability

The Service is provided "as is" without warranties of any kind. To the maximum extent permitted by law, Smart DigitalWay shall not be liable for any indirect, incidental, or consequential damages arising from your use of, or inability to use, the Service, including loss of business, leads, or data. Our total liability for any claim arising from these Terms shall not exceed the amount you paid us in the 3 months preceding the claim.

10. Governing Law

These Terms are governed by the laws of India. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts located in India.

11. Changes to These Terms

We may update these Terms from time to time. We will post the revised Terms on this page with an updated "Last updated" date. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
